1. USER INFORMATION

Who is responsible for processing your personal data?

LLUIS BLANCH SA is the DATA CONTROLLER responsible for processing the USER’s personal data and informs them that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data and what is the purpose?

Depending on the form through which we have obtained your personal data, we will process it confidentially in order to achieve the following purposes:

In the Contact form

  • Respond to enquiries or any type of request submitted by the user through any of the contact methods made available on the controller’s website.

  • Send advertising and commercial communications by email, fax, SMS, MMS, social media, or any other electronic or physical means, whether existing now or developed in the future, that enables commercial communications. These communications will be sent by the data controller and will relate to its products and services, or those of its partners or suppliers with whom it has entered into promotional agreements.   • Carry out statistical analyses and market research.

In the Request a Quote form

  • Send commercial quotations for products and services. (For the performance of a contract or pre-contractual measures, Article 6.1.b of the GDPR)
  • Send advertising and commercial communications by email, fax, SMS, MMS, social media, or any other electronic or physical means, whether existing now or developed in the future, that enables commercial communications. These communications will be sent by the data controller and will relate to its products and services, or those of its partners or suppliers with whom it has entered into promotional agreements. In the User Registration form

  • Manage the user’s account in order to provide personalised access to the website and the interactive services it offers. (Based on the consent of the data subject, Article 6.1.a of the GDPR)

In the E-commerce form

  • Manage your online purchase or order, process payment, and proceed with its delivery or activation, in accordance with the general terms and conditions of contract. (For the performance of a contract or pre-contractual measures, Article 6.1.b of the GDPR)
  • Manage, maintain, improve, or develop the services provided. (For the performance of a contract or pre-contractual measures, Article 6.1.b of the GDPR)
  • Conduct satisfaction and quality surveys. (Based on the legitimate interest of the data controller, Article 6.1.f of the GDPR)

In the Booking form

  • Formalise bookings at the data controller’s establishment. (For the performance of a contract or pre-contractual measures, Article 6.1.b of the GDPR)
  • Send advertising and commercial communications by email, fax, SMS, MMS, social media, or any other electronic or physical means, whether existing now or developed in the future, to customers, enabling commercial communications regarding products or services similar to those initially contracted by the customer (Article 21.2 of the LSSI). (Based on the legitimate interest of the data controller, Article 6.1.f of the GDPR)

How long will we keep your personal data?

Your data will be kept for no longer than necessary to maintain the purpose of the processing or while there are legal obligations requiring its retention. When it is no longer necessary, it will be deleted using appropriate security measures to ensure data anonymisation or complete destruction.

Who do we share your personal data with?

No personal data will be communicated to third parties unless necessary for the development and execution of the purposes of the processing. In such cases, data may be shared with our service providers related to communications, with whom the DATA CONTROLLER has signed the confidentiality and data processing agreements required by current privacy regulations.

In the case of payments made by card through the Stripe payment gateway, payment data will be securely transmitted to Stripe Payments Europe Ltd., based in Ireland, which may process such data through its parent company, Stripe, Inc., in the United States. This international transfer of data is covered by the European Commission’s adequacy decision regarding the EU–U.S. Data Privacy Framework and, where applicable, by standard contractual clauses approved by the European Commission.

What are your rights?

The rights available to the USER are:

  • Right to withdraw consent at any time.
  • Right of access, rectification, data portability, and erasure of personal data, as well as the right to restrict or object to its processing.
  • Right to lodge a complaint with the supervisory authority (www.aepd.es) if the user considers that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By selecting the corresponding checkboxes and entering data in fields marked with an asterisk (*) in the contact form or in download forms, USERS expressly and freely accept that their data is necessary for the provider to process their request. Providing data in the remaining fields is optional. The USER guarantees that the personal data provided to the DATA CONTROLLER is accurate and is responsible for communicating any changes to such data.

The DATA CONTROLLER informs that all data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all required data is not provided, the DATA CONTROLLER cannot guarantee that the information and services provided will be fully tailored to the USER’s needs.


3. SECURITY MEASURES

In accordance with current personal data protection regulations, the DATA CONTROLLER confirms that it complies with all provisions of the GDPR and the LOPDGDD regarding the processing of personal data under its responsibility, and specifically with the principles set out in Article 5 of the GDPR, whereby data is processed lawfully, fairly, and transparently in relation to the data subject, and is adequate, relevant, and limited to what is necessary for the purposes for which it is processed.

The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS, and has provided them with the necessary information so they can exercise those rights.
